Chapter 52. Weed Control and Abatement.

All owners and persons in possession or control of any lands within the city shall:

(1) Prevent the growth of noxious weeds or vegetation as defined by the Code of Iowa, from reaching maturity or blooming by cutting or destroying same.

(2) Cut or destroy all weeds, vines, brush or other similar vegetation when said growth exceeds ten (10) inches in height on any developed parcel within the City or within one hundred (100) feet of any developed parcel. In other areas of the city, any weeds, vegetation, vines, brush or other growth shall be cut or destroyed when said growth exceeds two (2) feet. Natural areas, including but not limited to waterways or farmland, may exceed these established height limitations.

(3) Prevent any growth of weeds, vines, brush or other similar vegetation which constitutes a health, safety or fire hazard regardless of height.

Time for Cutting Weeds and Assessment of Costs.

The above mentioned ordinance is in effect from April 1 to November 1 of each year. If a property owner or person in possession of lands in the city fails to destroy the weeds, vines, brush, or other similar vegetation as set out in this chapter, the City shall cause to have the work done and the total cost and expenses of destroying the weeds or growth shall be paid and assessed against the land as provided by law.

Hourly rates are as follows:

City: $100 per man-hour (rounded up to the next ½ hour) with a minimum charge of not less than $100 for any and all man-hours or fractional portions thereof (as noted above) expended by the City abating any weed conditions in the event that a property owner fails to comply with any required notice received in this matter.

Additionally, an administrative charge as shown below shall be added to the bill for any subsequent violations:

1st violation within two (2) years after initial notice - $100

2nd violation within two (2) years after initial notice - $200

3rd violation within two (2) years after initial notice - $300

4th and subsequent violations within two (2) years after initial notice - $400 per violation.

Private Contractor: Cost +25%.
